Terms of Service

Effective date: [Insert launch date]  ·  Last updated: September 16, 2026

⚠ Safety comes first — read this before anything else

DockNav IQ is a navigational aid, not a substitute for safe driving, professional judgment, or your company's safety policies. You are solely responsible for operating your vehicle safely and legally at all times. Do not interact with the app in any way that violates distracted-driving laws in your jurisdiction — use voice input, a co-driver, or pull over safely to make changes.

Routing, bridge clearance, weight limit, and hazard data is provided for reference only and is not guaranteed to be complete, current, or accurate, including data submitted by other drivers. Always verify against posted signage, your dispatch instructions, your ELD, and your own judgment before proceeding. DockNav IQ is not liable for tickets, damage, delays, or injury resulting from reliance on app data — see Section 8.

Plain-English summary

01 Acceptance of Terms

DockNav IQ is operated by DockNav IQ LLC, a New Mexico limited liability company. By downloading, installing, or using DockNav IQ (the "App," "Service," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the App. These Terms work together with our Privacy Policy, which explains what data we collect and how.

02 Description of the Service

DockNav IQ provides commercial-truck routing, real-time hazard alerts, and crowdsourced facility arrival information ("the Last 500 Feet") for gates, guard shacks, staging areas, and loading docks. Some data comes from official sources (state DOT feeds, mapping providers); other data is submitted by drivers using the App and has not been independently verified by us — see Section 5.

03 Eligibility & Accounts

You must be at least 18 years old and hold a valid commercial driver's license or be otherwise legally authorized to operate the vehicle you use with the App. Browsing the map, car navigation, and facility search are available without an account. Truck navigation requires a DockNav account with a Pro subscription or an active free trial; an account (email and password) is also required to purchase and manage a subscription.

You're responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately of any unauthorized use.

04 Subscriptions & Payments

Paid subscriptions are billed and processed through the Apple App Store or Google Play, not directly by us. By subscribing, you agree to that store's payment terms in addition to these Terms.

05 User-Submitted Content

When you submit a hazard report, facility information, a photo, or a correction ("Content"), you grant DockNav IQ a worldwide, non-exclusive, royalty-free license to use, display, and distribute that Content within the App to help other drivers — including showing your photo to other users or using your report to power hazard alerts.

You're responsible for what you submit. Don't submit Content that is:

We may remove, hide, or down-rank any Content at our discretion, including through the App's automated photo moderation and community reporting/voting systems. Crowdsourced Content is not independently verified and may be inaccurate, outdated, or incomplete — see the Safety Notice at the top of this page and Section 8.

06 Acceptable Use

You agree not to:

07 Intellectual Property

The App, including its design, branding, and underlying software, is owned by DockNav IQ and protected by intellectual property laws. Except for Content you submit (Section 5), you may not copy, modify, distribute, or create derivative works from the App without our permission.

08 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ROUTING, HAZARD, WEATHER, OR FACILITY DATA (INCLUDING DRIVER-SUBMITTED CONTENT) IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

YOU ARE SOLELY RESPONSIBLE FOR COMPLYING WITH ALL APPLICABLE TRAFFIC LAWS, BRIDGE AND ROAD RESTRICTIONS, YOUR COMPANY'S SAFETY POLICIES, AND SAFE VEHICLE OPERATION, REGARDLESS OF WHAT THE APP DISPLAYS.

09 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCKNAV IQ AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP — INCLUDING DAMAGES RESULTING FROM RELIANCE ON ROUTING, HAZARD, OR FACILITY DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $50 IF YOU HAVEN'T PAID ANYTHING.

Some jurisdictions don't allow certain limitations on liability, so some of the above may not apply to you.

10 Indemnification

You agree to defend and indemnify DockNav IQ against any claims, damages, or expenses arising from your use of the App, your Content, or your violation of these Terms.

11 Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, including submitting fraudulent or abusive Content.

12 Changes to the Service or Terms

We may update the App or these Terms as the product evolves. We'll update the "Last updated" date above, and for material changes we'll provide notice within the App. Continued use after a change means you accept the updated Terms.

13 Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.

Note on this draft: this document was drafted to accurately reflect how the DockNav IQ app actually works today, for use as the Terms of Service required by App Store Connect and Google Play Console. It is a starting point, not legal advice — especially the liability limitation and governing-law sections, which should be reviewed by a lawyer familiar with your jurisdiction and with commercial-driving/navigation-app liability specifically before you rely on it. Fill in the bracketed placeholders (launch date, governing-law jurisdiction, support email) before publishing.
